Request made to Redland City Council:

'Concession' to allow Disability Permit holders to park in frequently vacant Boat Trailer Parking bays.

After conducting the 14-day (Oct 25) Survey of the 7-Day Boat Trailer Parking, it was very clear that this zone is significantly underutilised. (Survey on Disabled Parking Dilemma page)

It was clear that this Zone could adequately act as an overflow for Disability Permit holders when no Disabled Parking bays were available.

A request was sent to RCC suggesting a 'Concession' be offered to such Permit holders, providing the Disability Permit was displayed. The 'Survey' was provided to RCC as proof of usage.

The 'Concession' is to be a temporary measure until such time as further Disabled Parking was developed. Eg: the old toilet block vacant land.

Redland City Council rejected the suggestion and will continue to impose fines to cars even when with displayed a Disability Permits in that Zone

Redland City Council rejection is clearly disability discrimination as this impedes the independence, accorded to the disabled, by TMR document 'Access rights under Disability Standards for Accessible Public Transport’

The Redland City Council rejection is clear evidence that Council breached:

1: The Disability Discrimination Act 1992 (the DDA),

2: AHRC document: 'Guidelines: Equivalent Access under the Disability Standards for Accessible Public Transport'

3: Dept Transport & Main Roads: : Accessible Public Transport Standards

RCC have the means to change that sign to read: "No Parking - Car with Boat Trailer and Disability Permit Excepted"

Redland City Council Rejection Response

This is considered Direct Discrimination

Direct discrimination generally occurs when a person with a disability is treated less favourably (by RCC) than a person without the disability in the same circumstances. Under federal laws, direct discrimination also includes circumstances where there is a failure to make 'reasonable adjustments' that results in the less favourable treatment.
